Terms of Service

Last Updated: May 1, 2025  ·  Effective Date: May 1, 2025

Please read these Terms carefully before using our services. By requesting a quote, submitting a booking, or using our website, you agree to be bound by these Terms of Service.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Yorkers Auto Transport ("Company," "we," "us," or "our"), a licensed auto transport broker operating from 34 Morton St, Brentwood, NY 11717.

By accessing or using our website at yorkersautotransport.com, requesting a quote, booking transport services, or communicating with our team, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

These Terms, together with our Privacy Policy and Refund & Cancellation Policy, form the complete agreement between you and Yorkers Auto Transport.

2. Definitions

Broker
Yorkers Auto Transport — acting as an intermediary to arrange vehicle transport between the Customer and a Carrier.
Carrier
A federally licensed and insured motor carrier assigned to physically transport your vehicle.
Customer
The individual or entity requesting vehicle transport services through Yorkers Auto Transport.
Order
A confirmed booking for vehicle transport services, including pickup and delivery details.
Bill of Lading
The legally binding document issued at pickup and delivery, documenting vehicle condition and constituting the contract of carriage.
Dispatch
The moment a specific Carrier is assigned to your order and confirmed for pickup.
Shipment
The vehicle(s) being transported under a confirmed Order.

3. Our Role as a Broker

Yorkers Auto Transport operates as a licensed motor carrier broker, not a carrier. Our role is to arrange transportation services by matching your shipment with licensed, insured Carriers in our network. We do not physically transport vehicles ourselves.

As a broker, we are responsible for:

  • Verifying that assigned Carriers hold active FMCSA operating authority and cargo insurance
  • Coordinating pickup and delivery scheduling
  • Serving as your primary point of contact throughout the shipment
  • Facilitating communication between you and the Carrier
  • Assisting with damage claims and dispute resolution

The Carrier is responsible for the physical transport of your vehicle and is the legally liable party for any vehicle damage that occurs during transit under their custody and control.

4. Booking & Order Confirmation

An Order is confirmed when you receive a written confirmation from Yorkers Auto Transport via email or text message. Verbal agreements are not binding until confirmed in writing.

By booking our services, you represent and warrant that:

  • You are the legal owner of the vehicle, or have been authorized by the owner to arrange transport
  • All information provided (vehicle details, addresses, contact information) is accurate and complete
  • You are at least 18 years of age
  • You have the authority to enter into this agreement

Providing false or inaccurate information may result in order cancellation without refund, additional charges, or both.

5. Pricing & Payment

The price quoted to you by Yorkers Auto Transport is confirmed in writing before any commitment to book. We do not change your price after booking — the rate you receive in your written confirmation is your final rate.

Quoted rates are based on vehicle type, route, transport method, and current market conditions. Rates may differ from estimates if:

  • Vehicle information provided was inaccurate (e.g., actual vehicle size or condition differs from what was stated)
  • Route or pickup/delivery locations change after booking
  • The vehicle is inoperable but was represented as operable at the time of booking

Payment terms are communicated at the time of booking. The Carrier typically collects the carrier fee directly at pickup or delivery. Any broker fee structure will be clearly disclosed before booking.

6. Pickup & Delivery

We provide door-to-door service wherever legally and safely accessible. The Carrier will attempt pickup and delivery at your specified addresses. If a location is not safely or legally accessible for a large transport vehicle (due to narrow streets, low bridges, weight restrictions, or local ordinances), you will be asked to meet the Carrier at a nearby accessible location such as a parking lot or wide street.

You or an authorized representative (18 years of age or older) must be present at both pickup and delivery to inspect the vehicle and sign the Bill of Lading. Vehicles will not be released without a signature from an authorized party.

Pickup and delivery dates are estimates. While we make every effort to meet scheduled dates, they are not guaranteed due to factors including weather, traffic, mechanical issues, and carrier scheduling. Yorkers Auto Transport is not liable for delays caused by circumstances beyond our reasonable control.

7. Vehicle Preparation

Prior to pickup, the Customer is responsible for preparing the vehicle as follows:

  • Fuel level: Keep the tank at approximately ¼ full — enough for loading/unloading, not a full tank
  • Personal items: Remove all valuables and minimize personal belongings (see Section 12)
  • Convertible tops: Fully raise and secure all convertible tops
  • Loose items: Secure or remove all loose exterior items (antennas, spoilers, bike racks)
  • Alarm systems: Disable car alarms or provide the disarm code to the driver
  • Toll transponders: Remove or deactivate E-ZPass, SunPass, or other toll devices
  • Parking permits: Remove city, residential, or parking permits from the vehicle
  • Documentation: Leave a copy of the vehicle registration in the glove box
  • Battery: Ensure the battery is charged and the vehicle can start normally

Failure to properly prepare the vehicle may result in additional charges or refusal of transport without refund.

8. Bill of Lading & Condition Reports

The Bill of Lading (BOL) is the legally binding contract between you and the Carrier. It documents the vehicle's condition at both pickup and delivery and serves as your primary protection in the event of a damage claim.

Critical: Always inspect your vehicle thoroughly BEFORE signing the Bill of Lading at delivery. If damage is present, note it specifically on the BOL in writing before signing. Signing a clean BOL without noting damage may waive your right to file a damage claim.

At pickup, the driver will inspect your vehicle and note any pre-existing damage. You should:

  • Review the inspection notes carefully before signing
  • Take your own photographs of the vehicle from all angles before loading
  • Retain a signed copy of the Bill of Lading for your records

At delivery, repeat the same inspection process and compare the vehicle's condition against the pickup BOL. Any new damage must be noted on the delivery BOL before signing.

9. Insurance & Liability

All Carriers in our network are required by FMCSA regulations to maintain active cargo insurance covering your vehicle during transport. We verify carrier insurance before dispatching any order.

The Carrier's cargo insurance is the primary coverage for any vehicle damage that occurs while the vehicle is in the Carrier's custody and control. Coverage limits vary by carrier but meet or exceed federal minimums.

As a broker, Yorkers Auto Transport does not provide direct cargo insurance coverage on your vehicle. Our role is to ensure the assigned Carrier is insured and to facilitate your claim with the Carrier if damage occurs.

We recommend notifying your personal auto insurance provider that your vehicle will be transported. Your personal auto insurance may provide additional coverage during transport depending on your policy terms.

10. Damage Claims

If you believe your vehicle sustained damage during transport, follow these steps immediately:

  1. Do not sign a clean delivery receipt — Note all damage on the Bill of Lading before signing
  2. Photograph all damage — Take detailed photos from multiple angles at the time of delivery
  3. Contact Yorkers Auto Transport — Call (201) 431-5897 or email us within 24 hours of delivery
  4. Obtain the carrier's insurance information — We will provide carrier insurance details upon request
  5. File a claim directly with the Carrier — Damage claims are the legal responsibility of the Carrier, not the Broker

Important: Damage claims reported more than 24 hours after delivery may not be honored. Damage not documented on the delivery Bill of Lading is significantly harder to substantiate. Always inspect thoroughly at delivery.

Yorkers Auto Transport will assist you in facilitating your claim but cannot guarantee outcomes. Ultimate liability rests with the Carrier and their insurance provider.

11. Delays & Transit Times

All transit times and pickup/delivery dates provided by Yorkers Auto Transport are estimates only, not guarantees. Auto transport is subject to variables including but not limited to:

  • Weather conditions and natural events
  • Road closures, construction, or traffic delays
  • Mechanical breakdowns
  • Changes in carrier schedules
  • Federal hours-of-service regulations for truck drivers
  • Seasonal demand fluctuations

Yorkers Auto Transport is not liable for any costs or damages resulting from transit delays, including rental vehicle expenses, lodging costs, missed appointments, lost income, or any other consequential damages.

12. Personal Items in the Vehicle

Most carriers permit a reasonable amount of personal items in the vehicle during transport, typically limited to 100 lbs or less in the trunk. However:

  • Personal belongings are NOT covered by the Carrier's cargo insurance
  • Yorkers Auto Transport assumes no liability for personal items left in the vehicle
  • Valuables, electronics, documents, jewelry, and cash should never be left in the vehicle
  • Carriers have the right to refuse transport if personal items exceed weight limits or violate safety regulations
  • Items left in the vehicle are transported entirely at the Customer's own risk

We strongly recommend removing all personal items before your vehicle is picked up.

13. Cancellation & Refunds

Please review our complete Refund & Cancellation Policy for full details. Key terms are summarized below:

  • Before dispatch: Full cancellation without penalty. No fees charged.
  • After dispatch (carrier assigned): A cancellation fee applies to cover administrative costs and carrier reservation fees. See our Refund & Cancellation Policy for the applicable amount.
  • After vehicle pickup: Orders cannot be canceled once the vehicle has been loaded onto the carrier.

To cancel an order, contact Yorkers Auto Transport immediately by phone at (201) 431-5897 or by email at contact@yorkersautotransport.com. Cancellations must be confirmed in writing.

14. Prohibited Items & Vehicles

The following are prohibited from being transported by Yorkers Auto Transport:

Prohibited Items Inside the Vehicle:

  • Firearms, ammunition, or weapons
  • Illegal substances or controlled substances
  • Explosives, flammable liquids (beyond standard vehicle fuel), or hazardous materials
  • Live animals or plants
  • Perishable foods or beverages
  • Irreplaceable documents, family heirlooms, or items of extreme sentimental value

Vehicle Conditions Requiring Disclosure:

  • Inoperable or non-running vehicles must be disclosed at time of booking — surcharges apply
  • Modified, oversized, or lowered vehicles must be disclosed — additional equipment fees may apply
  • Vehicles with body damage, fluid leaks, or mechanical issues must be disclosed before pickup

Failure to disclose prohibited items or vehicle conditions may result in additional charges, order cancellation without refund, or legal liability.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Yorkers Auto Transport's total aggregate liability arising from or related to any shipment shall not exceed the total amount paid by the Customer to Yorkers Auto Transport (broker fee) for the specific shipment giving rise to the claim.

Yorkers Auto Transport shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, loss of use, rental vehicle costs, lodging expenses, missed appointments, lost income, or any other economic loss, even if advised of the possibility of such damages.

This limitation applies to the fullest extent permitted by law and reflects an allocation of risk between the parties that is reflected in the pricing of our services.

16. Indemnification

You agree to defend, indemnify, and hold harmless Yorkers Auto Transport and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of our services or website
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Inaccurate or misleading information you provided to us
  • Any prohibited items transported in or with your vehicle

17. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions, and applicable federal law including FMCSA regulations.

Any dispute arising out of or relating to these Terms or our services shall first be submitted to good-faith negotiation. If not resolved within 30 days, disputes shall be resolved through binding arbitration in Suffolk County, New York, under the rules of the American Arbitration Association.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Yorkers Auto Transport. Claims must be filed within one (1) year from the date the claim arose or they are permanently barred.

18. Changes to These Terms

We reserve the right to update these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of our services after any changes constitutes acceptance of the revised Terms.

We encourage you to review these Terms periodically. For significant changes, we may provide additional notice through email or a prominent notice on our website.
